This limitation applies regardless of the legal theory asserted and even when the possibility of damages was known or should have been known.
To the fullest extent permitted by law, SoftScale AI’s total aggregate liability arising from or relating to general use of the Website will not exceed the greater of:
- The amount you paid directly to SoftScale AI through the Website for the specific product or service giving rise to the claim during the 12 months preceding the event giving rise to liability; or
- One hundred U.S. dollars ($100).
This liability cap does not replace a different limitation expressly stated in a separate binding agreement governing a specific engagement.
Some jurisdictions do not allow certain exclusions or limitations of liability. In those jurisdictions, these limitations apply only to the maximum extent permitted by law.

21.Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless SoftScale AI and its owners, officers, employees, contractors, representatives, and affiliates from third-party claims, demands, actions, damages, judgments, liabilities, losses, costs, and reasonable expenses, including reasonable attorneys’ fees, arising from or relating to:

26.No Waiver
